Indian Court Rules Sex With Minor Wife Is Rape

Indian apex court ruled Wednesday sexual intercourse with underage wife is to be considered as rape. The court added even consensual sex with woman under 18 years would be seen as the same under the law.

The legal age of consent in India is 18 years and an exception made by Supreme Court reads consensual sex between a man with wife between age 15 and 18 would not be termed as rape.

In the country marital rape is not a crime as it would destabalise marriages and wives may harass their husband unnecessarily.

The court was hearing a petition by a non-profit group named Independent Thought seeking to criminalise sex with underaged wives.

Child marriage is deeply rooted in the country and the reasons responsible for it includes weak law enforcement, poverty, concerns about family honor and patriarchal social norms.

However, the situation is changing and in the 2011 census the child marriage declined marginally over the period of one decade.

More than 25 percent of the married women said they were wedded before they turned 18. About 20 percent of married men said they had married women who were below age 18.

On global front India is one of the top ten countries where child marriage statistics is highest. The other countries include Chad, Guinea, South Sudan, Niger and Burkina Faso.
